For homeowners afflicted by water leaks attributed to the Iplex ”Pro-Fit” pipes, the legal landscape surrounding these defects is as complex as it can get.

The Current Landscape

At the moment there are three major limits to the Iplex issues:

  1. The WA State Government and the manufacturer, Iplex, have developed a coordinated Industry Response Western Australian Industry Response to help remediate the issue – but not all home builders have signed on to it.
  2. A class action has also been commenced in the Federal Court of Australia against Iplex (Class Action), which homeowners are likely to be a party to.
  3. It is even more complicated if your builder did not sign on to the State’s Industry Response but has been joined to the Class Action by Iplex.

 

So where does all of this leave you?

First, this is a rare case where the problem is not a lack of options.  Rather, it is the much less common problem of there being a lot of options.  So, the questions confronting home-owners are more driven towards what the differences between the options are and which is the most suitable option for you.

Adding even more complexity is the existence of the Industry Response.  There are questions about whether it will survive should the Class Action proceed and what that would mean if does not.
