Environmental Lawyer, Solomon Brothers has represented a large number of clients in connection with their mining and resources projects (including projects prospective for nickel, iron oxide, copper, gold, uranium and bauxite).
Partner, David Marsh, is the former national president of AMPLA (Australian Mining Petroleum Law Association) and is currently a member of AMPLA’s WA State Committee. In these roles, he assisted with the preparation of the AMPLA Model Mining Services agreement. Two of our partners are also directors of two ASX listed mining companies.
Joint Ventures and Farm-ins
The team at Solomon Brothers has experience in drafting and negotiating complex:
- farm in and joint venture agreements;

- tribute agreements.
Grants of Mining Tenements
We have, on behalf of our clients, successfully challenged decisions of the mining warden to grant, or to refuse to grant, applications for mining tenements (recently, we successfully assisted a client to obtain an order recommending forfeiture of a mining tenement and successfully opposed a judicial review of that decision in the Supreme Court).
Acquisition and Divestment of Mining Tenements
Solomon Brothers commonly prepares documentation to facilitate the sale and purchase of mining tenements, including preparing and negotiating:
- mining tenement sale agreements;
- put and call option deeds for the sale and purchase of mining tenements,
- mining tenement transfer forms;
- mortgages of mining tenements; and
- royalty deeds.
